The terms that govern your use of Quokit

1. Acceptance of terms
These Terms of Service govern your access to and use of Quokit. By creating an account, signing in, saving items, sharing lists, claiming gifts, starting a free trial, subscribing to Premium or otherwise using Quokit, you agree to these Terms.
If you do not agree to these Terms, do not use Quokit.
2. Description of service
Quokit is a wishlist saving and gift-coordination service. It helps users save product URLs, organise wishlist items, share lists with trusted people, coordinate gift claims and use AI-assisted search and item enrichment.
Quokit is not a retailer, marketplace, seller, broker or purchasing agent. We link to third-party retailers and services. Purchases, shipping, returns, product quality, warranties and retailer customer service are handled by the relevant third party, not Quokit.
3. Account registration
You must provide accurate account information, including a valid email address. You may create one account per person unless Quokit gives prior written permission. You are responsible for maintaining the security of your account, keeping access to your email secure and notifying us promptly if you suspect unauthorised access.
You must not create an account using another person's identity, impersonate another person, use misleading account details or transfer your account without permission.
4. Acceptable use
You must use Quokit lawfully and respectfully.
- Do not use Quokit for illegal activity, fraud, harassment, abuse or infringement of third-party rights.
- Do not scrape, crawl, bulk extract, reverse engineer or interfere with Quokit.
- Do not abuse the service, attempt to bypass limits, overload infrastructure or probe internal APIs.
- Do not impersonate another person or misrepresent your connection to another person or organisation.
- Do not save malware URLs, illegal content or content that violates third-party terms of service.

5. Free and Premium tiers
Quokit may offer Free and Premium tiers. The Free tier includes feature limits designed for basic personal use. Premium unlocks full features such as expanded usage, advanced gift coordination and other paid functionality shown in the app.
Quokit offers a 14-day free trial, no credit card required. The free trial is available once per user. Users under 16 cannot create paid accounts.
6. Subscriptions and billing
Premium subscriptions are processed by Stripe. Current pricing is shown in the app. Pricing may change — users will be notified before any change takes effect on their account.
Subscriptions renew automatically unless cancelled before the renewal date. You can cancel through account settings or by contacting hello@quokit.com.au. Cancellation stops future renewal, but does not automatically refund the current billing period unless the Refund Policy requires otherwise.
Stripe may store payment method details, issue invoices, process taxes where applicable and provide the customer portal used to manage billing.
7. Refunds
Refunds are governed by the Refund Policy at https://www.quokit.com.au/refunds. Nothing in these Terms or the Refund Policy limits rights you may have under the Australian Consumer Law.
8. Intellectual property
Your wishlist content belongs to you. You grant Quokit the limited rights needed to host, process, display, share, back up and transmit your content so we can provide the service.
The Quokit brand, product design, software, code, logos, trade marks, interface, documentation and related intellectual property belong to us or our licensors. You must not copy, modify, resell, sublicense or create competing services from Quokit except as allowed by law or with prior written permission.
9. Third-party links
Quokit links to retailers and other third-party websites. We are not responsible for third-party sites, product listings, prices, availability, delivery, returns, warranties, customer service, security practices or privacy practices. You should review retailer terms before making a purchase.
Product metadata may be provided by retailer APIs, webpage extraction, AI-assisted enrichment or user input. Quokit aims to present useful information but does not guarantee that product data, prices, images or availability are complete, current or error-free.
10. Anonymous gift coordination
Anonymous gift coordination is a Premium feature designed to help preserve surprise while reducing duplicate gift purchases. Quokit uses database-layer protections so list owners on Premium cannot see who claimed gifts until they choose to reveal claim information.
We do not guarantee surprise preservation if users disclose information outside Quokit, share screenshots, use multiple accounts, coordinate outside the app or otherwise circumvent the intended flows.
11. Service availability
We aim to provide a reliable service, but Quokit is provided on an availability basis and we do not guarantee 100% uptime. The service may be interrupted by maintenance, incidents, third-party outages, security issues, network failures or changes to third-party APIs.
We may change, suspend or discontinue features where needed to maintain security, comply with law, improve the product or manage third-party provider changes.
12. Termination
You may delete your account at any time. Account deletion starts an immediate soft delete and Quokit hard deletes personal account data after 30 days, subject to legal, security, billing and dispute-resolution retention needs.
We may suspend or terminate accounts that violate these Terms, the Fair Use Policy, payment obligations, security rules or applicable law. We may also restrict features, remove content or take protective action to prevent harm to Quokit or other users.
13. Limitation of liability
To the extent permitted by Australian Consumer Law, Quokit is not liable for indirect, incidental, special, consequential or loss-of-profit damages, loss of data, loss of goodwill, third-party retailer disputes or purchases made through third-party links.
Nothing in these Terms excludes, restricts or modifies rights, guarantees, remedies or protections that cannot be excluded under the Australian Consumer Law.
14. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and Quokit submit to the courts of New South Wales and any courts that may hear appeals from those courts.
